Medical Debt and Bankruptcy
All medical debt is fully dischargeable, in both Chapter 7 Bankruptcy and Chapter 13 Bankruptcy proceedings.
When someone is struggling to pay off medical bills, my heart goes out to them. This is a burden that truly no one asks for, and our country’s for-profit health insurance system
causes some patients to take on completely unexpected five and even six figure debt
amounts, for a necessity they had no choice or bargaining power over.
It is essential to gauge the timing of your bankruptcy filing if you still are dealing
with recurring medical issues. Filing for bankruptcy too early could leave you with more high medical bills that accrue after you have already received your discharge from your debts.
Conversely, waiting too long to petition the court for bankruptcy relief could cause you to be sued by a medical creditor, or debt collector. I will counsel you with this
consideration top of mind.
Last, it is important to be aware that medical creditors commonly do not report to
credit bureaus. This means you will not see these debts when reviewing your credit
report (which my office pulls for you). I will need to obtain the info on these medical
creditors directly from you.
If your medical debts are interfering with your financial freedom, call my office
